BENEFITS EXPERT: Can I claim carer’s allowance even if I’m stuck in lockdown?

Again we are presenting some common benefit Q&A's we have been getting during lock down.

As always the position often changes on a daily basis so always keep an eye on the news for new developments.

It has also come to our attention that information on some government websites, automated recordings, etc. have not been updated so you may obtain conflicting advice.

Finally a lot of these changes have been via guidance and have not yet been legislated for so caution is advised as the legislation changes may not reflect the guidance.

Q. I claim Carer's Allowance but due to lock down measures I'm not able to assist the person I care for.

Can I still receive Carer's Allowance given the circumstances?

A. Yes, the government has confirmed that if you are self-isolating in line with current guidance you can still get Carer's Allowance.

The other main rules still apply in this situation such as any income from employment, the person cared for gets a qualifying benefit.

Q. I had a date for a tribunal hearing for a benefit appeal, obviously I know I won't be able to attend in person but what will now happen?

A. Firstly make sure any evidence you planned to use at the hearing has been sent to the tribunal service.

The judge will consider all evidence and make a provisional decision based on this.

The decision will be sent to you and the DWP. If both parties accept the decision then the judge will formally confirm this.

If you or the DWP do not accept the decision the matter will proceed to a full hearing and this will likely be done by telephone conference and you'll be sent information on organising this.
