Sunderland man breached restraining order imposed after he was jailed for burgling his mother's home

A Sunderland man has been fined for contacting his mother despite being banned from doing so after being jailed for burgling her home.

Dillon Murray, 23, of Hylton Road, was imprisoned for 50 weeks in October 2018 but got in touch with his brother at her address in a bid to get hold of his mail after his release.

But his brother informed their mother who in turn contacted police to inform them of Murray’s breach of a restraining order.

South Tyneside Magistrates’ Court heard Murray was “shocked and dismayed” at being prosecuted.

However, district judge Kathryn Meek fined Murray, who pleaded guilty to a charge of harassment by breaching a restraining order, £100 and ordered him to pay another £117 in court and other costs.

She told him: “These are slightly unusual circumstances, but you are big enough and old enough to sort this out.”

Prosecutor Clare Irving told the court: “Following a conviction of burglary at his mother’s property, the defendant tries to get post from his brother at their mother’s.

“He says that he’s aware that the restraining order is in force and accepts that it’s a breach and that he doesn’t want his mother worrying over this. Mum reported it.”

Jason Smith, defending, said: “He can’t believe that he’s here just for asking for something that was his. He’s not tried to contact his mum at all.

“He simply wanted to get something that was his so he could sort out his accommodation after custody.

“He’s trying to move on with his life and certainly doesn’t want to be in court. He was a little bit shocked and dismayed that this has happened.”

The court heard Murray’s restraining order breach happened on Thursday, October 3, this year.
