Sunderland driver failed to give breath test after downing bottle of Lambrini

A DRIVER has been banned from the roads for two years after he failed to complete an alcohol breath test.

Police were called to Peter Proctor’s home in Welwyn Close, North Hylton, on September 3 after receiving information that he had been driving.

They found the 58-year-old asleep on a sofa and his wife confirmed he had just returned home in his car having drunk a bottle of Lambrini. Two unsuccessful attempts were made to collect a sample of breath.

Proctor, who has had a clean driving licence for 40 years, admitted failing to provide a specimen of breath before Sunderland magistrates.

Gerry Armstrong, mitigating, said Proctor had broken ribs at the time and was unable to carry out the test. He was also fined £150 with £85 costs and a £20 victim surcharge.
