A dad-of-two who was awoken with a punch from his ex-partner ended up in court when he punched her in return.
Philip Nicholls, 33, admitted common assault on the woman submitting a basis of plea, that the victim attacked him first.
Prosecutor Paul Anderson said the domestic incident took place on April 9.
“The defendant was awoken from his sleep by the injured party punching him to the head,” Mr Anderson said.
“The defendant then followed her out of the bedroom to the top of the stairs and punched her once to the head.”
Gerry Scott, defending, said the industrial cleaner, of Staveley Road, Seaburn Dene, was “thoroughly ashamed” of his actions.
Magistrates fined Nicholls £120 with £85 costs and £20 surcharge. No compensation was awarded due to the level of provocation from the victim.
